I missed filing an update yesterday. I was tied up with some non-bar review items, and I eventually had to go to bed. (I would have liked half of that time more than half of the time it will take to write this post to have done some bar studying.)

Let's see. Torts was Day 7 and Day 8. The lecturer was Professor Roger E. Schechter. He looks like this:

However, when his name came up, I had to go run off an check whether this was really Torts, because I knew the name from this, which helped me survive my Patent Law final. (It's a nice, slim volume covering a large chunk -- though by no means all -- of patent law.)

Prof. Schechter was entertaining. Lots of jokes. Lots of visuals. No clips from "The Simpsons," however, which was what my Torts professor used to give us visuals.

I'm of a mixed mind what I thought of it. I imagine each of the lectures could have been considerably shorter without the filler. On the other hand, there were some gems, like this factor for considering one's status in a fragile class for purposes of Intentional Infliction of Mental Distress:

plaintiff is a member of a fragile class of persons

  • young children ("he's 5 years-old for crying out loud. He's going to start crying and vibrating and pooping all over himself")
  • elderly (who are apparently incontinent and will respond like the 5 year-old; whole supermarket aisles dedicated to this "fact")
  • pregnant women (defendant must know that plaintiff is pregnant)

Today was our first essay workshop with Professor Sakai, who is doing them live for us. All told, I think I could do without the essays. Not the workshops, but actually having to do the essays.
